1) Object of the contract
These conditions of sale have as their object the purchase of products and services, carried out remotely via telematic network, by Agriland24 S.r.l.s. – Via De Pizzini 1 – 38061 Ala (TN), Tax Code / P. Iva 02356000220, C.C.I.A.A. REA n ° 218654, holder of the domain name www.agriland24.it.
Each purchase transaction will be governed by the provisions of Legislative Decree no. 185/99 and, as regards the protection of confidentiality, will be subject to the legislation referred to in Law no. 675/96 and subsequent amendments.
2) Acceptance of the conditions of sale
The contract stipulated between Agriland24 and the Customer must be considered concluded with the acceptance of the order by Agriland24. This acceptance is considered tacit. By placing an order in the various ways provided, the Customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the general and payment conditions set out below.
If the Customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity), once the purchase procedure has been completed, he will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of art. 3 and 4 of Legislative Decree 185/1999 on distance selling and, as regards the protection of confidentiality, will be subject to the legislation referred to in Law no. 675/96 and subsequent amendments.
Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or non-contractual liability for direct or indirect damages to persons and / or things, caused by the non-acceptance, even partial, of an order.
Agriland24 reserves the right at any time and without prior notice to raise the prices of the products on sale according to the directives of the suppliers and the prices of transport.
2.a) Causes of force majeure: Agriland24 srls declines all responsibility for any inconvenience, of various kinds, caused by force majeure such as: wars, fires, earthquakes, epidemics or other natural or economic / political disasters that may affect the regular fulfillment and delivery of orders.
3) How to buy
The Customer can only purchase the products in the online catalog of www.agriland24.it at the time of placing the order as described in the relevant information sheets. It is understood that the image accompanying the description of a product may not be perfectly representative of its characteristics but differ in color, size, accessory products present in the figure. All information supporting the purchase is to be understood as simple generic information material, not referable to the real characteristics of a single product.
The correct receipt of the order is confirmed by Agriland24 by means of an e-mail response, sent to the e-mail address communicated by the Customer at the time of registration. This confirmation message will contain an 'Order Number', to be used in any further communication with Agriland24. The message reproduces all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections, in the manner described in this document.
In case of non-acceptance of the order, Agriland24 guarantees timely communication to the Customer.

The purchased products are supplied packed or on pallets, to be mounted with any assembly instructions.
Write on the courier's delivery note upon receipt of the goods: "Subject to verification" to protect against any damage caused during transport. In the absence of this phrase it will not be possible to open the accident and request reimbursement of the damage.
The images of the products for sale published on the site are only indicative, any accessories or parts not explicitly mentioned in the description may not be included in the supply.
4) Right of withdrawal
Pursuant to art. 5 DL 185/1999, if the customer is a consumer (ie a natural person who buys the goods for purposes not related to his professional activity, or does not make the purchase by indicating in the order form to Agriland24 a reference of VAT number), he has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, except as indicated in the following point.
To exercise this right, the customer must send Agriland24 S.r.l.s. a communication to that effect, within 14 days from the date of receipt of the goods.
This communication must be sent by registered letter with acknowledgment of receipt, addressed to Agriland24 S.r.l.s. – Via De Pizzini 1 – 38061 Ala (TN), or by telegram or email (pec) to firstname.lastname@example.org always sent within the aforementioned period of 14 days and followed by a confirmation by registered letter with acknowledgment of receipt, sent STRICTLY within the following 48 hours. Once we have received the aforementioned notice of withdrawal, the Customer Service Agriland24 S.r.l.s. will quickly communicate to the customer the instructions on how to return the goods that must be received by Agriland24 S.r.l.s. within 14 days of authorization." We inform you that the complaint can also be submitted through the ODR Platform of the European Commission at the link http://ec.europa.eu/odr" In this regard, we point out that, once the "Conciliareonline.it" clause has been inserted in the general conditions of sale, companies must send appropriate communication to the e-mail address firstname.lastname@example.org providing the e-mail address of the office or reference person for the processing of complaints, after which they will be included on their website within the list of Companies that benefit from the "Conciliareonline.it" clause.
5) The right of withdrawal is in any case subject to the following conditions of sale:
5.A) the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the product purchased;
5.B) the right does not apply to products of agricultural, gardening and municipal equipment, once opened;
5.C) the purchased good must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc ...); to limit damage to the original packaging, we recommend, when possible, to place it in a second container or pallet, bearing the RMA number (return authorization code); the affixing of labels or adhesive tapes directly on the original packaging of the product must be avoided in all cases;
5.D) in accordance with the law, the shipping costs related to the return of the goods are charged to the customer;
5.E) the shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer;
5.F) in case of damage to the goods during transport, Agriland24 S.r.l.s. will notify the customer of the incident (within 5 working days of receipt of the goods in its warehouses), to allow him to promptly file a complaint against the courier chosen by him and obtain reimbursement of the value of the goods (if insured); in this case, the product will be made available to the customer for its return, simultaneously canceling the request for withdrawal;
5.G) Agriland24 S.r.l.s. is not liable in any way for damage or theft / loss of goods returned by unsure shipments;
5.H) upon arrival at the warehouse, the product will be examined to assess any damage or tampering not resulting from transport. If the packaging and / or the original packaging are damaged or tampered with, Agriland24 S.r.l.s. will withhold from the refund due a percentage, in any case not exceeding 10% of the same, as a contribution to the costs of restoration.
Without prejudice to any restoration costs for damage ascertained to the original packaging, Agriland24 S.r.l.s. will refund the customer the amount of the item already paid, as soon as possible and in any case within 90 days from the request for withdrawal, through the transfer procedure of the amount charged to the Credit Card or by bank transfer. In the latter case, it will be the customer's authority to promptly provide the bank details on which to obtain the refund (ABI Code – CAB – Current Account of the invoice holder). The shipping costs incurred by the customer for the receipt of the goods, for the subsequent return or for any other movements will not be refunded.
The right of withdrawal is totally lost, for lack of the essential condition of integrity of the goods (packaging and / or its contents), in cases where Agriland24 S.r.l.s. ascertains:
– the lack of the external packaging and / or the original internal packaging;
– the absence of integral elements of the product (accessories, cables, manuals, parts, etc.);
– damage to the product for reasons other than its transport.
In the event of forfeiture of the right of withdrawal, Agriland24 S.r.l.s. will return the purchased good to the sender, charging the same shipping costs.
The "Money Back Guarantee" is to be considered applicable according to the methods indicated in the aforementioned points.
Any refund includes only the cost of the goods and not the shipping costs.
The right of withdrawal provided for in the Consumer Code concerns only the consumer. The notion of "consumer" is provided for in"consumer or user: the natural person acting for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out". Therefore, since the holder of a VAT number is a professional, and not a consumer, he will not be able to exercise the right of withdrawal governed by the Consumer Code.
6) Withdrawal costs
The fixed cost to exercise the right of withdrawal, as reimbursement of expenses to the Agriland24 S.r.l.s. is equal to the sum of:
For orders under € 500.00 the fixed amount is € 50.00.
For orders from € 500.00 and up to € 2,499 the fixed amount is € 120.00.
For orders from € 2,500 upwards the fixed amount is € 250.00.
All products sold by Agriland24 S.r.l.s. are covered by the manufacturer's conventional warranty and the 12-month warranty for defects of conformity, pursuant to Legislative Decree 24/02. The manufacturer's conventional warranty is provided in the manner described in the documentation inside the product packaging. If, following intervention by an Authorized Service Center, the defect should not be covered by the manufacturer's conventional warranty, the Customer will be charged for any costs of verification and restoration required by the Authorized Assistance, as well as transport costs, if incurred by Agriland24 Srls.
The 12-month warranty pursuant to Legislative Decree 24/02 applies to the product that has a lack of conformity, provided that the product itself is used correctly, in compliance with its intended use and as provided in the attached technical documentation. This guarantee is reserved for the private consumer (a natural person who purchases the goods for purposes not related to his professional activity, or makes the purchase without indicating a VAT number reference in the order form). In case of lack of conformity, it provides, at no cost to the Customer, to restore the conformity of the product by repair / replacement or reduction of the price, until the termination of the contract. If, following intervention by an Authorized Service Center, the defect does not result in a lack of conformity pursuant to Legislative Decree 24/02, the Customer will be charged for any costs of verification and restoration required by the Authorized Assistance, as well as transport costs if incurred by Agriland24 Srls. Replacements in case of DOA (Dead On Arrival: product not working on delivery) take place only if expressly provided by the manufacturer.
The timing of replacement or possible repair of the product depends exclusively on the manufacturer's policies. In the event that, for any reason, it is not able to return to its customer a product under warranty (restored or replaced), it may proceed at its discretion to return the entire amount paid or to replace it with a product of equal or superior characteristics. No damage can be requested to Agriland24 S.r.l.s. for any delays in carrying out repairs or replacements.
In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the Customer (at his expense) in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc ...); to limit damage to the original packaging, we recommend, when possible, to put it in a second box; in all cases, the affixing of labels or adhesive tapes directly on the original packaging of the product should be avoided.
Agriland24 Srls reserves the right to cancel the order if typing errors or price counting are found.
Agriland24 Srls is in no case responsible for damage caused to things or people due to any misuse of the equipment, or for any other cause, even in case of application of the same equipment to tractors or other means.
The personal data requested during the placing of the order are collected and processed in order to satisfy the express requests of the Customer and will not be in any case and for any reason transferred to third parties. Agriland24 S.r.l.s. guarantees its customers compliance with the legislation on the processing of personal data, governed by the privacy code referred to in Legislative Decree 196 of 30.06.03.
Agriland24 S.r.l.s. periodically sends advertising emails only to customers who have expressed their consent during registration by ticking the appropriate item "Subscribe to the Newsletter".

Any complaint must be addressed to Agriland24 S.r.l.s. by sending an e-mail to email@example.com by phone at (+39) 0464 015015, (+39) 3408708230, or by mail by writing to Agriland24 S.r.l.s. – Via De Pizzini 1 – 38061 Ala (TN). The sales contract between the Customer and Agriland24 S.r.l.s. is concluded in Italy and governed by Italian law.
For the solution of civil and criminal disputes arising from the conclusion of this distance sales contract, the territorial jurisdiction, both for the private customer and for the customer with a VAT number, is exclusively that of the Trento forum.
